Terms of Use and Sale

Article 1 — Purpose

These terms govern access to MyPokerCaptain, a poker tournament management application published by SunStar Decision, and the sale of its subscriptions. Creating an account constitutes acceptance.

Article 2 — The service

MyPokerCaptain lets you prepare and run tournaments: clock, blind structure, registrations, seating, payout scale, cash desk, room display, standings.

The clock and the running of the tournament work on your device, without depending on the network. An internet outage does not interrupt a tournament in progress; it only pauses saving and broadcasting to other screens, which resume once the network is back.

We aim for continuous availability of the online services without guaranteeing it: an interruption for maintenance or a hosting outage remains possible.

Article 3 — Account and activation

Creating an account requires a valid e-mail address, confirmed by a code sent to that address. You are responsible for the accuracy of the information provided and for keeping your password confidential.

An account is personal. A club, however, can bring together several accounts, with distinct roles.

Article 4 — The 14-day trial

Each club can try a paid plan for fourteen days. No payment method is required: there is therefore nothing to cancel, and no charge can occur at the end of the trial.

At the end of the fourteen days, the club automatically returns to the free plan. Its tournaments, players and history stay in place; only the features of the trialed plan close.

The trial is limited to once per club. We notify you by e-mail three days before it ends, the day before, and the day after it ends.

Article 5 — Plans and pricing

Home Games: €7.99 per month or €79.90 per year. Club: €12.99 per month or €129.90 per year. Casino: €47.99 per month or €479.90 per year.

All prices are shown with all taxes included, including French VAT at 20%. The free plan remains available with no time limit.

We may change our prices. Any change is announced by e-mail at least thirty days before it applies, takes effect only at the next renewal, and leaves you free to cancel before then.

Article 6 — Payment

Payment is made by credit card or by the other methods offered, via our provider Stripe. Banking details are entered with them and never pass through our servers.

The subscription renews automatically at each billing cycle, monthly or annual, until canceled. The invoice is available at any time from the subscription management area.

In the event of a failed payment, Stripe makes several retry attempts. Without resolution, the paid features close and the club returns to the free plan, with no data loss.

Article 7 — Right of withdrawal

Consumer customers generally have fourteen days to withdraw from an online purchase. As the service is provided immediately after subscribing, you expressly request its immediate performance at the time of payment and, in doing so, waive this right of withdrawal, in accordance with articles L221-25 and L221-28 of the French Consumer Code.

This waiver is not a trap: the fourteen-day trial, free and with no credit card, exists precisely so you can decide with full knowledge of the facts before paying anything.

Article 8 — Cancellation

The subscription has no minimum term. It can be canceled at any time from the Plan screen, “Manage subscription” button, in a few clicks and without having to write to us.

Cancellation takes effect at the end of the already-paid period: the club keeps using it until then, then returns to the free plan. Periods already begun are not refunded on a pro-rata basis.

We may, for our part, suspend an account that harms the service or its users, after notifying you except in an emergency.

Article 9 — Your data

Your club's data belongs to you. You can export it at any time from the application, and request its complete deletion by writing to us.

The processing of this data is described in the privacy policy, which forms part of these terms.

Article 10 — Liability

MyPokerCaptain is a tool: the running of a tournament, the enforcement of its rules and the distribution of winnings remain the responsibility of its director. We are not a party to the games played or the money at stake.

It is your responsibility to check that the tournaments you organize comply with the regulations that apply to you.

Our liability, except for bodily injury or gross negligence, is limited to the amounts you have paid us over the past twelve months.

Article 11 — Governing law and disputes

These terms are governed by French law.

In the event of a dispute, write to us first: most are resolved in a single exchange. Consumer customers can then turn to a consumer mediator free of charge; write to contact@mypokercaptain.com to obtain their contact details.

Failing an agreement, the dispute falls under the jurisdiction of the competent courts. The consumer retains the right to bring the matter before the court of their place of residence.
